Official “VFTW/AskMeNow Flat Screen Sweepstakes” Rules:

1. No purchase necessary to enter or win. Purchase will not improve odds of winning. Sweepstakes period will run from 12:00 PM EST April 3, 2007 to 11:59:59 PM EST on May 1, 2007. Sweepstakes will consist of one drawing weekly for the period of four (4) weeks. Beginning April 3, 2007, entries received between 12:00 Noon EST on Tuesdays and 11:59:59 PM EST on the following Monday will be considered eligible for that week’s drawing. Sponsor’s clock governs time. AskMeNow is not responsible for lost, stolen, misdirected, delayed, destroyed or illegible entries.
2. Eligibility: Must be 13 years of age to participate (upon verification of prize eligibility, misrepresentation of age requirement will void the entry). Sweepstakes is open only to individuals who reside in and are physically located in the 50 United States (excluding Rhode Island), and the District of Columbia (excluding Puerto Rico and all other territories).

By entering the Sweepstakes, participants agree to release, discharge and hold harmless AskMeNow, its affiliates, subsidiaries, officers, directors, employees and agents from any and all damages, costs, expenses, and other liabilities, including damages for personal injury or damage to property, whether the damages are direct or indirect, and regardless of whether the claim is based on contract, tort or any other legal theory, which may be due to or arise out of participation in the Sweepstakes or any portion thereof or the acceptance, use/misuse or possession of the prize.

Employees, officers, directors, agents, representatives and their immediate families (spouse, parents, children, siblings, and each of their spouses regardless of where they live) or members of household of AskMeNow, Inc., their respective subsidiaries, advertising, design, web design, web hosting and publicity agencies and anyone connected with the production or distribution of this Sweepstakes are not eligible to enter or be awarded a prize.

By participating, you agree to these Official Rules and to the decisions of AskMeNow being final and binding in all respects. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations in the US and Canada apply.

1. To Enter: Sweepstakes consists of four (4) weekly drawings. To enter via mobile text VFTW to the short code 27563. Or, you may enter the Sweepstakes by sending a 3½”x5½”, postage-paid, postcard with your hand printed name, complete mailing address and date of birth to “VFTW/AskMeNow Flat Screen Sweepstakes”, c/o AskMeNow, 26 Executive Park Suite 250, Irvine CA, 92614. Limit one entry per person. All entries except weekly winners will be rolled over from one Weekly Drawing Period to the next. Mailed entries that are larger than 4”x6”, or inserted in envelopes will be discarded. All mail-in entries received by days-end of the Monday will be included in the following week’s drawing.
2. Selection of Winner: Potential winner will have to agree to accept the prize and supply/confirm full contact information within 48 hours of date on email or phone message left or it will be concluded definitively that the prize has been refused and an alternative potential winner will be chosen in random drawings. Entries will be rolled over from one Weekly Drawing Period to the next. However, to be eligible to win the prize in each Weekly Drawing Period you must enter as per the instructions in #3 above during each Weekly Drawing Period.

Each week’s prize will be a 37” flat screen TV, ARV $1000 - $1200. Should the value of the prize be less than the ARV stated in these Official Rules, the difference will not be awarded in cash. A prize will be awarded only if it is claimed properly. Limit one weekly prize per person, household or email address during this sweepstakes. Odds of winning: Dependant on the number of eligible entries received during each Weekly Drawing Period. All taxes are winner’s responsibility and a form 1099 will be sent for the ARV of any prize valued over $600.

1. General: Sweepstakes administration and winner selection and verification will be conducted by AskMeNow whose decisions are final and legally binding. No participant or winner shall have the right to contest any decision by Sponsor or the interpretation of the Official Rules or the determination as to the qualification of entries. By participating in this Sweepstakes, you agree to be bound by these Official Rules. Sponsor is not responsible for those who cannot access the Internet or cannot click-through, or text in, for any period of time regardless of technical, hardware, software, telephone, Internet, virus contamination or network problems, or for delay, failure or malfunction for any reason including, but not limited to, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, Force Majeure, typographical or system errors, human errors, including but not limited to, errors by Sponsor’s representatives who enter incorrect information into any of Sponsor’s computer systems. Sponsor not responsible for lost, late, mutilated, illegible or postage-due mail-in entries. Proof of entry is not proof of entry receipt. Sponsor reserves the right to cancel/terminate, modify or suspend the Sweepstakes if in Sponsor’s sole determination it believes that the integrity of the Sweepstakes has been, or could be, compromised or that the Sweepstakes is not capable of running as planned or fairly, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or Force Majeure or any other causes beyond Sponsor’s control. In such case, winner will be drawn from among all eligible entries logged up to the time of cancellation/termination and mail-in entries postmarked by cancellation/termination day and received up to seven (7) days later. The remaining drawings will be cancelled. Sponsor reserves the right to disqualify any entry from the Sweepstakes if in Sponsor’s sole judgment entrant has not complied with these Official Rules. Without limitation, all of an entrant’s entries will be disqualified, at the sole discretion of Sponsor, if entrant attempts (i) to enter the Sweepstakes through any means other than as described in these Official Rules; or (ii) provides information that is inaccurate or fraudulent; or (iii) attempts to disrupt the Sweepstakes or circumvent the terms and conditions of these Official Rules. Sponsor assumes no liability for damage caused to entrant's or any other person's/entity's computer hardware, software or communications network, regardless of cause. All prizewinners will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release within five (5) days of date on notification or it will be concluded definitively that the prize has been declined and, without further notice, an alternative winner may be selected in random drawings. All entries submitted become the property of Sponsor and none will be returned or acknowledged.
2. Acceptance of the prize constitutes permission to use the winner's name, voice and likeness and any and all identifying characteristics for promotional, advertising and publicity purposes (including posting to the AskMeNow website); this permission includes, but is not limited to, the taking of photographs and/or videos by Sponsor's photographer/videographer for publicity purposes, without further consent or compensation, unless prohibited by law and winner agrees to execute any and all documents requested by Sponsor to convey such rights to own all the results thereof. Nothing contained herein shall be deemed to obligate Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind.
3. Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or the prize awarded and all issues and questions concerning the validity, interpretation and enforceability of these Official Rules shall be resolved individually, without resort to any form of class action, and exclusively in a court of competent jurisdiction sitting in Orange County, CA. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes and never shall include consequential, incidental or punitive damages, and in no event attorneys' fees. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
4. Names of each week’s winners will be posted online at www.votefortheworst.com and will be sent through VFTW Mobile Updates or may be obtained by sending a self-addressed, stamped #10 envelope to: AskMeNow, 26 Executive Park Suite 250, Irvine CA, 92614.
