You may remember us posting this video a while ago, that Daughtry's awful song Feels Like Tonight sounds very much like The Asphalt's Tonight. We've gotten word that Dr. Luke and company, the writers of Daughtry's probable rip-off, are suing the Asphalt for their song Tonight. Dr. Luke proports that the Asphalt are defaming him by having their song appear out of obscurity, and that they are stealing from his song. Wait, what? So both parties claim they wrote the original song and the other stole it? We're more inclined to believe The Asphalt, as why would they make this up, and Dr. Luke has been accused of this theft in the past too. But seriously, the song sucks. It's like claiming ownership of a turd. But we're inclined to side with the little guys. VFTW got our hands on a copy of the court filing, so click "read more" for some highlights.

Under the heading of "Nature of the Claim," sections 2 &; 3 appear to have been written with the assistant of a publicist. Seriously? Max Martin wrote a song for Mos Def? I find that very difficult to believe. This comes across as a pre-emptive strike. Douchebag Daughtry and his douchebag lawyers wanted to get this in before the little guys could get the ball rolling.

I didn't know a pleading can be that flowery. LOL. I read several complaints and information in the past, this is perhaps the first time that i've seen the phrase "immensely popular Grammy-nominated". I found that hard to believe.. It's almost self-proclaimed.
